Eagle River Rep. Kelly Merrick has filed to run for Senate. She made it clear today in a filing with the Alaska Public Offices Commission.
Merrick represents what used to be called District 14. During redistricting it became Senate Seat L. Redistricting had pushed Merrick and Rep. Ken McCarty.
That district picks up three precinct from Rep. Cathy Tilton and Sen. Shelley Hughes, all very conservative, except for one precinct. Merrick, who left the Republican caucus and joined the Democrat-led caucus in the House, became the House Finance co-chair.
District 22 Republicans censured Merrick for joining with the Democrats earlier this year.

House District 40 includes all uplands and islands within the Northwest Arctic Borough and the North Slope Borough.
Through the end of September 2021, a total of 13,265 Covid-19 vaccine breakthrough cases were documented among Alaska residents, according to the Alaska Department of Health and Social Services. An additional 2,906 cases occurred among Alaska residents who were partially vaccinated.
The state notes that the incidence of Covid-19 among vaccinated persons has remained consistently lower than among persons who were unvaccinated.
As the number of vaccinated persons increases in Alaska, so do breakthrough cases. But in September the breakthrough cases set a new high of 35.2 percent of all known Covid cases.
Alaskans started receiving Covid vaccines in March, when Alaska Governor Mike Dunleavy announced the shot would be available for all individuals who live or work in Alaska and are age 16 and older, making Alaska the first state in the nation to remove eligibility requirements. By May, Alaskans as young as 12 were allowed to get the vaccine.
Vaccinations for Covid are reducing hospital stays for those Alaskans who choose to get the vaccine, but since July, the rate of hospitalization for Covid breakthrough cases jumped dramatically has averaged 56 cases per month.
The State’s official position is that:
Covid-19 vaccines continue to provide strong protection, especially against hospitalization and death.
Most Covid-19 hospitalizations in Alaska could be prevented by vaccination.
Covid-19 cases have become more common among fully vaccinated persons than they were in the initial months after vaccine roll-out, but fully vaccinated people continue to be less likely to have Covid-19 than people who aren’t fully vaccinated.
CDC recommends that fully vaccinated persons wear masks in public indoor settings in areas with substantial to highcommunity transmission.
While people can be infected with Covid-19 multiple times, prior infection confers partial protection. Vaccination provides additional protection in those who have been infected and is recommended regardless of history of prior infection.
The hunt is on. A doctor in Anchorage has put out the word that she hopes others in her profession will follow to weed out doctors they don’t agree with.
Dr. Leslie Gonsette has written to the Providence Alaska Medical Executive Committee to say that she had contacted the Alaska State Medical Board to urge it to take action against certain physicians spreading “harmful misinformation.”
The State Medical Board meets on Nov. 19, 2021.
Gonsette said she is disturbed by those who don’t follow the mainstream medical information of “best practice, sound research and science,” which she said will lead to the “future safety of health care will be compromised.”
It appears from the email to the Providence MEC that Dr. Gonsette is targeting certain doctors who have been prescribing ivermectin as an early treatment for those who are infected by the Covid-19 virus.
The written testimony she provided will be a public document and Must Read Alaska has sent a public records request to obtain a copy of it.
This Veterans Day I’d like us to consider what it means to “march to the sound of the guns.”
That military aphorism may have its roots in the Civil War or possibly World War II. It was likely first issued as a directive by a military officer: “You men! March to the sound of the guns!”
Before radios and cell phones and hundreds of years prior to the instant text message, it was a very brief command to take specific action and it focused attention on what was important. It communicated the commander’s confidence in his countrymen in so few words. You’ll know what to do when you get there. Get into the fight!
A contemporary veteran is a volunteer. Everyone currently serving in the U.S. military has raised their hand of their own volition and promised to defend the Constitution and to obey the orders of the president of the United States and the officers appointed over them.
We have veterans in our midst who were drafted into the Vietnam War, Korean War, and World War II. Many were conscripted against their wishes. Nonetheless, as veterans, they will forever be remembered as those who answered the call to march to the sound of the guns, literally and figuratively.
Voluntarily getting on the bus to travel to initial entry basic training is an anxiety producing activity for most people, as you might well imagine. So much more so is the act of moving by foot, horseback, or by vehicle to the growing sound of a battle raging. Marching to the sound of the guns takes courage and commitment. When all of life’s trappings are stripped away and the fight is imminent, fear is overcome by duty.
This Nov. 4 marked the 245th anniversary of the final signature on the Declaration of Independence by a man named Matthew Thornton of New Hampshire. Altogether, 56 men inked their name to the document that sparked the Revolutionary War. That declaration concluded with the words “with a firm reliance on the protection of divine Providence, we mutually pledge to each other our Lives, our Fortunes and our sacred Honor.” Most definitely, a step toward the sound of the guns.
Our nation’s independence was seized by men with a vision of something greater than their fortunes, and even their lives. It was seized by men who didn’t wait for others to act on their behalf and were willing to endure sacrifice. Pledging lives, fortunes, and sacred honor can never be a one-time sacrifice paid by their generation to secure ours. Each subsequent generation must make a similar pledge and endure sacrifice to maintain what is valuable.
There are those amongst us who naturally move to the sound of the guns, veterans and non-veterans alike. If you’re like me, you can see the fabric of our society bursting at the seams as if prosperity has resulted in excessive, harmful self-indulgence and apathy. The battle is raging.
Our nation desperately needs more volunteers to trust in divine providence, willingly endure sacrifice, and join the march to the sound of the guns. Benjamin Franklin was 70 years old when he signed the Declaration of Independence. The youngest signer was 26-year-old Edward Rutledge.
March to the sound of the guns and get into this fight! You’ll know what to do when you get there. Commit to participating in our ugly process of self-government so that future veterans must not shed blood to regain what we willingly gave up. Duty calls!
Rep. Ben Carpenter, a war veteran, represents House District 8 — Nikiski and other communities on the Northern Kenai Peninsula. This is the district previously known as District 29.
During another meeting of the Anchorage Assembly, the nine-member liberal majority has continued to take more power away from the Mayor’s Office and establish itself as a secondary executive branch.
On a vote of 8-2, with John Weddleton absent, the Assembly changed municipal code that gives it complete authority over whatever meeting spaces it uses, whether it’s the Assembly Chambers in the Loussac Library, the Wilda Marston Theater next door, or a meeting room in City Hall.
The matter is a separation of powers issue for both the mayor and the Assembly. The municipal charter gives the mayor power over all facilities in the city, ostensibly to reduce the spread of Covid-19. Such Assembly measures in the past are the reason that the Anchorage voters went with a conservative mayor, Dave Bronson, during the last election, rather than liberal Forrest Dunbar.
A primary issue is whether the Assembly can keep the public from attending its meetings, as the liberal majority has done by limiting capacity in the Assembly Chambers.
Municipal Manager Amy Demboski argued that she had made multiple efforts to accommodate the Assembly, to no avail.
“The Chair mentioned in her opening remarks that this issue has been ratcheting up, which is simply false and a misrepresentation of the facts,” Demboski said on Wednesday night.
“First, as mayor indicated yesterday, offer to cross train multiple times Assembly/clerk staff on technology to assist in the recording and broadcasting equipment, which, to my knowledge has not been responded to by Assembly leadership,” she said.
“Second, I personally spoke to the Chair prior to an Assembly meeting a while back and agreed to modify capacity limits to ensure the Assembly members were more comfortable; yet on the record 15 minutes later the chair expressed that the Administration was unwilling to work with the Assembly,” Demboski continued. She went on to say that through the city’s Department of Law, she had offered a compromise on Wednesday, but her effort to work with the Assembly Chair Suzanne LaFrance was rebuffed.
“Yet, that offer was not entertained, and tonight we heard the perspective that the issue was ratcheting up – clearly the opposite of the reality,” she said.
Demboski, who once served on the Assembly on behalf of Eagle River, said, “State law is clear, the executive has control over real and personal property of the municipality. Whether you like it or not, buildings, facilities, are real or personal property. Furthermore, this ordinance attempts to exercise control over executive branch personnel which is clearly a power articulated to the Executive branch in Charter and in State Law.”
Demboski said the ordinance is a violation of the separation of powers, “and is an attempt by the legislative branch to take power from the executive branch.”
The other ordinance that passed on Wednesday requires the mayor to bring forward his appointees to the Assembly for confirmation more within 60 days. Although it was watered down from the original draft, the ordinance notes in the “whereas” clauses that Mayor Dave Bronson’s choices for directors have been at times controversial.
The Assembly was particularly displeased with the mayor over his appointment of Sami Graham as library director, and subsequent appointment of Judy Eledge to that role after Graham was not confirmed. The two women have advanced degrees but the Assembly wants a person in that position that has a masters of library science.
Eledge has since stepped down as library director to take a non-confirmable position of deputy director, thus robbing the Assembly of its ability to get rid of her.
The Assembly majority of nine want to prevent him from allowing people to serve in key positions for several weeks or months before the Assembly has a chance to dismiss them by refusing to confirm.
Since the conservative mayor was elected in May, the liberal Assembly has increased its assertion of power, including passing an “emergency ordinance” that put masks on Anchorage residents to reduce the spread of Covid.
The Wednesday meeting was sparsely attended by the public. The Assembly will meet again on Friday in executive session to discuss its interest in not confirming the current Department of Health director.
The Anchorage Coalition to End Homelessness has hired Anchorage Assemblywoman Meg Zaletel as interim executive director, effective immediately.
Zaletel currently represents Anchorage Assembly District 4, a midtown area. The group calls her a subject matter expert on fair housing and homelessness. In her role as chair of the Assembly Committee on Housing and Homelessness, she has been a negotiator on behalf of the Assembly to the Office of the Mayor on issues surrounding homelessness and the mayor’s plan to form up a navigation center to help people get back on their feet. She has been hostile to that concept in favor of her own ideas.
Now, Zaletel will have to recuse herself on the Assembly when it comes to voting on any issues involving homeless policy or appropriations and will step down from her role as chair of the Committee on Housing and Homelessness.
The nonprofit coalition receives local, state, and federal funds, as well as support from private philanthropy. One year ago, a Jeff Bezos foundation, Day 1 Families Fund, awarded the coalition $450,000. Last year, the group had a budget of $1,240,895.
The board at the homeless coalition may be appointing Zaletel as interim for now, in order to allow her to serve the remainder of her term on the Assembly. They may require her to step down from the Assembly, rather than run again, since the Assembly is now spending well over 40 hours a week in meetings, which leaves little time for Assembly members to hold down full-time jobs. This is an indication that she does not intend to run for reelection.
Zaletel’s move to the nonprofit organization was expected; those close to the matter said the organization wanted to wait until the recent special recall election was over; Zaletel won it handily with help from New York funding from a labor union political action committee. That result was certified by the Assembly on Tuesday.
The former director of the homelessness coalition, Jasmine Boyle, resigned in early November to take a position at another nonprofit in Anchorage.
Kathy Henslee has filed for the District 4 Assembly seat; that election is in March and April.
A political action committee to support the campaign of Sen. Lisa Murkowski was filed on Tuesday by Jim Lottsfeldt, of Lottsfeldt Strategies.
Lottsfeldt is a longtime political operator in Alaska associated with mainly Democrat and Big Labor candidates.
The filing for Alaskans for Lisa was made with the Internal Revenue Service and is the first true sign that Sen. Murkowski is going to run for reelection in 2022. She has been a U.S. senator for Alaska since 2002 and most politicos expect her to form up her campaign committee soon. She is being challenged by upstart candidate Kelly Tshibaka, a Republican, and a likely Democratic Party challenge by State Sen. Elvi Gray-Jackson.
On the super-PAC filing, the treasurer is listed as Murkowski’s former chief of staff Michael Pawlowski, and the address is on the same floor in the Peterson Towers as Sen. Lisa Murkowski’s Anchorage office, which is located at 510 L Street, Suite 60O.
Next door to Sen. Murkowski’s office is the home of the law offices of Scott Kendall, a former Murkowski campaign manager who subsequently engineered the Ranked Choice Voting ballot measure that voters passed in 2020. The political action committee is in Suite 610, making the 6th floor of the Peterson Towers look like a formidable operation for Murkowski’s 2022 campaign.
Although they share a floor, no coordination can go on between the political action committee and Murkowski’s official office or Murkowski’s actual campaign. Federal election laws require a clean firewall between those entities.
Calling a new federal mandate for health-care workers an “insult to personal freedom to heath-care workers,” Gov. Mike Dunleavy joined a coalition of states Wednesday in a lawsuit seeing to block the Biden Administration’s effort to make health care providers force their employees to take the Covid-19 vaccine.
A new Centers for Medicare and Medicaid Service rule forces Covid vaccines for almost every full-time, part-time, volunteer or contract employee working in health care settings that receive Medicare or Medicaid funding. CMS estimates more than 10.3 million Americans would fall under this overarching mandate.
“This new rule is an insult to the personal freedoms of the health-care heroes who have been critical to Alaska’s response to the COVID-19 pandemic,” Dunleavy said. “This is unconstitutional and yet another example of the Biden Administration’s overreach on issues that should be left to the states.”
Alaska Attorney General Treg Taylor and attorneys general from nine other states filed the lawsuit in the U.S. District Court for the Eastern District of Missouri.
The states seek an injunction to prohibit CMS from enforcing the mandate on grounds that the rule violates the 10th Amendment, the federal Administrative Procedures Act and other federal laws.
“The 10th Amendment prohibits federal agencies from taking away powers that are reserved to the states, which know best how to enact the kinds of public health measures to best fit the needs of its citizens,” said Attorney General Taylor. “This rule would punish our rural hospitals and countless health care workers across Alaska by withholding Medicare and Medicaid funding if they don’t comply with a mandate. The courts have already stopped one overreaching federal vaccine mandate in the 5th U.S. Circuit of Appeals, and we hope this one will be blocked as well.”
The CMS mandate covers a broad group of Medicare- and Medicaid-certified providers and suppliers, including rural health clinics, hospitals, long-term care facilities and home health agencies. Under the rule, health care workers must receive their first vaccine dose by Dec. 5 and be fully vaccinated no later than Jan. 4. Unlike the proposed Occupational Safety and Health Administration (OSHA) rule, CMS’s regulations provide no mechanism for employees to undergo testing rather than be vaccinated.
The rule makes exceptions only for specific medical or religious reasons.
The health care industry already faces a worker shortage in nearly all areas, likely to be exacerbated by the CMS mandate. There are critical shortages of nursing aides and nurses at nearly a quarter of all American long-term care facilities. The lawsuit estimates that if the CMS mandate is left in place, more than 200,000 healthcare workers could lose their jobs.
The lawsuit calls the mandate “an affront to the millions of healthcare workers who risked their lives in the early days of the COVID-19 pandemic to care for strangers and friends in their communities,” and that the federal government has cast aside the health care workers who have personal reasons for not wanting the COVID-19 vaccine.
In addition to Alaska, the states in the lawsuit are Arkansas, Iowa, Kansas, Missouri, Nebraska, New Hampshire, North Dakota, South Dakota, Wyoming. Read the full complaint at this link.
