Culture wars continue as Colorado cake artist being sued in court for not celebrating gender transition with a special cake

Colorado cake artist Jack Phillips won in the U.S. Supreme Court after the Colorado Civil Rights Commission took action against him because he declined to design and create a custom wedding cake celebrating a same-sex marriage. That lawsuit was filed in 2012 and not resolved until 2018, when the Supreme Court ruled that the state had acted with “clear and impermissible hostility” toward Phillips’ religious beliefs, violating his rights under the First Amendment.

That same Colorado agency went after Phillips again, right after the Supreme Court decision, because he had declined to design a cake celebrating someone’s gender transition. Phillips filed a federal lawsuit against the agency in that case and the Colorado Civil Rights Commission withdrew its complaint.

Now, the person who requested the gender-transition cake is suing Phillips and Masterpiece Cakeshop in state court for discriminating against him/her.

Phillips doesn’t make cakes that advocate certain things that are in conflict with his deeply held Christian beliefs. Those include Halloween cakes, cakes that disparage people or degrade others. No, he won’t bake you a cake that celebrates Satan, demons, or blasphemy.

The attorney, formerly a man but now presenting as a woman, is Autumn Scardina, who called Masterpiece Cakeshop in June of 2017 and requested a custom cake designed with blue frosting on the outside and pink cake on the inside to celebrate and reflect a transition from male to female. The call came on the same day that the Supreme Court agreed to hear Phillips’ original case about the same-sex wedding cake.

“The shop declined the request [for a gender transition cake] because the message of the cake contradicts Jack’s religious belief that God creates us either male or female,” said Alliance for Defending Freedom.

“And a few months later, Scardina made another request of Masterpiece Cakeshop. This request was for a custom cake featuring Satan smoking marijuana,” ADF wrote.

Scardina first filed a charge against Phillips with the Colorado Civil Rights Division, which got involved but eventually dropped that case.

Scardina wasn’t done. He/she has taken the matter to a state court to litigate against Masterpiece Cakeshop.

“For some, it won’t be enough until Masterpiece Cakeshop closes its doors. They want Jack, an average American business owner, to pay a hefty price—all because he wants to live according to his faith,” ADF wrote.

  1. What ever happened to the sign often in businesses that claim they have the right to refuse service to anyone?

  2. Maybe we could send Scardina some cake mix and food coloring and he/she can make a cake any color he/she wants it to be..!!.

  3. I have zero doubt that this transgender person knew exactly what he/she was doing, knowing full well he wouldn’t bake a cake for him/her. Phillips will once again have to battle it out in court wasting precious cash he could be using for his store. It would be nice if once he wins his case, he can counter sue for lawyer fees.

  4. Make a huge cake, in the shape of a hand, with a long extension of the middle digit. Free wedding cake, courtesy of the straight world. Come on, man.

  5. No surprise that the person requesting the cake was a lawyer. This was pre-meditated. He/She/It/They knew ahead of time that Mr. Phillips wouldn’t bake the cake. The ambulance chasing lawyer was, in this case, driving the ambulance as well. I hope that Mr. Phillips sues him for harassment.

  6. This is all been tried and decided before. You don’t have to do anything if it’s against your personal beliefs or religion. Done deal and old news. The guy just thought he would try it again to get some public opinion going in this day and age when it seems that Americans are turning their backs on morals and putting ear plugs in every time they go by a bro lives matter rally.

  7. Be a shame if that lawyer, that thinks he’s a woman, were to have an accident and run face first into an object traveling at a high rate of speed.

  8. Even a blue icing over a covered pink cake isn’t going to make Autumn feel anymore like a girl. Transgenders, though they try, will always feel like their birth gender no matter how supportive their crowd. Apparently transgendered people all have root issue they lacked growing up with a good father figure.
Fathers Day is in two days. It should be a day dads and men reflect are they being a good husband/dad figure?

    Happy Fathers Day.

Agree, yes they know what there doing.
There just trying to shut down people, who don’t agree with them. Like you better wear the diaper mask too.

  10. Make the cake.
    .
Accidentally use salt instead of sugar. Whoops, grabbed the wrong bin, sorry. Here is your money back. Sorry your party was ruined. Would you like me to bake you a new one?

Can’t prove it was deliberate, therefore little possibility that a hate crime can be prosecuted.

  11. It is criminal the way these nacissistic, self indulgent, self absorbed people attack people they don’t even know and completly destroy their lives in an effort to thrust themselves into the lime light.

  12. Trans & his lawyer need to be sued for harassment, but that won’t happen because Jack Phillips is a practicing Christian who wants to forgive and move on. Jack is “loving his neighbor as himself”. The view of the world is, “They think it strange that you do not plunge with them into the same flood of dissipation, and they heap abuse on you.” (1Peter 4:4). More so with transgenders, because it is not enough for them to be merely treated as a human being with decency and respect – they demand that we celebrate with them their assumed identity. Their pain is great; and of the ones I’ve met, they are filled with anger.

  13. Welcome to Biden’s America, where you only count if you give up your rights to the woke mob! They have been persecuting Jack for years now because they just can’t handle someone who thinks differently then they do. It is called faith and having faith means believing in God’s holy word and living a life pleasing to him. The world wants to snuff out Christians because they honor God and his creation, the human body and the spirit that he has imbued in all of us. The world system is controlled by Satan and he is on the march seeking out those who belong to God. This war between good and evil has raged on for centuries and will end when the King returns, Jesus Christ. As the Bible says, “Every knee will bow and tongue confess he is Lord!” They will not have a choice once Jesus returns. They will be compelled to hear everything they have done in this life as written in the book of life described in God’s word. What many people refuse to understand is, God is Love, as he loves everyone on this Earth, but he will never condone or approve of Sin! His Son sacrificed himself to wash our sins clean to make us presentable to God. We are called to repent and glorify God by rejecting sinful behavior. Does that make us perfect? Absolutely not because there are none righteous without the blood of Christ and the belief that he is the only way we can approach God. So, let Jack be Jack and go to a different Baker Shop if you can’t handle it!
